BBFC DECIDES AGAINST APPEAL OVER JUDICIAL REVIEW
The BBFC has decided not to appeal the outcome of the Judicial Review on Tuesday 16 May. The High Court upheld the judgement of the Video Appeals Committee and as a result the seven videos involved in the appeal to the VAC will now be passed ‘R18’ for distribution through licensed sex shops only. The Board will also be reconsidering the Guidelines for ‘R18’ material in the light of this judgement.

- The appeal to the VAC was brought by Sheptonhurst Ltd and Prime Time Promotions (Shifnal) Ltd in 1999 against the Board’s decision to refuse ‘R18’ classification for seven titles: Horny Catbabe, Nympho Nurse Nancy, T.V. Sex, Office Tart, Carnival International Version (Trailer), Wet Nurses 2 Continental Version and Miss Nude International Continental Version. The VAC found in favour of the the two companies and the decision was announced on 16 August 1999.
- The Board sought the Judicial Review of the VAC’s judgement because in the Board’s view the judgement was based on a definition of harm which was an incorrect interpretation of the Video Recordings Act.
